Hi everyone,

I'm sharing my joy with you all that I got my golden email yesterday. This was happened just 1 business day after I made a complain call to the department. I am already outside the time frame at the time I called them. I complaint that to my knowledge application way behind me got finalized what is going wrong. I query application is not being processed by the time put in. I also complaint that there should be a time frame for CO when they received our updated document just like us only having 28 day to provide document when we were being asked for.

My timeline is:

Application submitted: 16 Feb 2018

I updated AFP since the old ones expired

1st Co contacted: 8th April 2019 (requesting AFP with alias name)

1st CO: Sophorn

updated AFP with alias name 29 April

I made complaint call at 26 July 2019

Granted: 29 July 2019 by CO Peter

The email was came in 30th

I wish good luck to every applicant in this forum

The worst thing you can do in this forum is to tell members the following,

'Living in regional area is only for two years out of four years in 489 visa duration. Once you have fulfilled meeting the requirement of staying two years in regional area and working full time for one year in regional area, one can move to metro area.'

No! The above is not true. Please do not suggest anything like this to anyone in 489 visa. Please do not confuse people. If you do not want to help anyone, that is fine but please do not misguide people.

Hi Guys,

Until you getting the PR (887), you have to follow the substantive visa rules .(i.e.489).

Don't be hurry to move metropolitan areas after lodging the 887 visa.

This is a terrible situation for you and your wife 😞 I think, you should consider going to another regional area, different state. Just start looking for any jobs you can possibly find in any regional postcode in Australia and then you find a job, if it is in a different state, contact Victoria migration authority and ask them to release you, show them that you are struggling. Even if you go to another regional area without permission from Victoria, you are not breaching visa conditions. You can do it.

Actually, this is true that someone mentioned further in this thread: you have completed 2 years in your state (Vic), now you do not owe them anything, you can go to another state. But it has to be regional!

But I am afraid nobody will allow you to work with 489 in metro. 😞 Theoretically, you can, but once you are found out, your visa will be cancelled. Please, don't risk it.

Thanks a lot for your advise buddy..actually at the moment, moving to another state is very expensive. I was thinking if there is any department of immigration where i can email them with my details, so that they can help me out. But thanks a lot for your advise buddy..you are truly a legend..

Meaning that the new 494 and 491 - which are the replacements for the 489 have Medicare from day 1? And Centrelink from day 1?

Whilst we had to wait until we applied for PR until we received Medicare (2 year minimum) ? Plus (with the new law effective 1 January 2019) that we have to wait 1 year from the date that we have received PR for any Family tax benefit and up to 4 year for any other Centrelink help...

Jeeeezzzz….unbelievable....

On top of that the long waiting period to even get our 887 assessed.

Look, I'm usually very positive towards everything, but this truly blows my mind.

Congratulations!!! I have a question regarding complaint, how did you compliant through call? Whenever I tried to complain the customer care person says “wait” and check your immi account. They not even asking for file no: or any other details of mine? Did you put a written complaint as well? Thank you

For Centrelink you are an Australian resident when:

You are an Australian resident if you live in Australia and are either:

  • an Australian citizen
  • a permanent residence visa holder, or
  • a protected Special Category visa (SCV) holder

Then, when looking at the following link, you see clearly that they have new waiting periods in force since 1.1.2019.

https://www.humanservices.gov.au/individuals/topics/newly-arrived-residents-waiting-period/30726

There is nowhere any mention that your previous visa (our 489) could count towards the waiting period.

So yes, more waiting for us...

Guys complain to commonwealth OMB and let them know that immigration issue visa unethically for crown casino. But not for the people who are coming here legally. This is fucking unbelievable. In Australia your first step starts with discrimination. 16 months for visa process. Unbelievable.

Congratulations!

We have applied on February 2018 as well and still no news on our visa. Can you please tell me where did you call to make a complain about the delay? I might do that as well because we are currently out of time frame.

Cheers

Hi,

If any one made a complain yet can you please tell me where should I write to is there any email or website to lodge the complain?

A phone number will help as well.

We are so frustrated as we are out of the time frame now and still no news.

Thanks

I made phone call to this number. It worked for me since I’m already OUTSIDE of the published time frame.

Hi Rupom,

It is really bad to hear about you. Which field you use to work? Living in regional area is only for 2years out of your 4 years 489 visa duration. Since you have already applied your 887. which means you met your requirement i.e 2 yrs of Stay and 1 yr of  Full time job. Now, why do you need to request to authority. Apparently, you are free to work anywhere in Australia now.

Thanks

Sudip

Hi. You can email the state to release you from living in Regional, since you are only committed to lived at Regional for 2 years anyway.

As long as you have all the documentation in place, you’ll be okay to moved  outside the regional, If the immig questioned you you can back it up with the advised given by the state with proof.

But don’t moved yet until they advised you.

Goodluck.

Hey it’s August now, all the student visas for July intake should be complete full stop now, hope things change!

Hey Nudgee, I do not understand the background of your statement. Would you mind explaining why this would impact our processing time?

Do ALL applications go through Adelaide for ANY visa? And do they only have 1 group of CO's that have to assess ALL visas?

I can only hope there is a department that assesses the 887 visas and another department another visa type.

Or am I wrong..

I understand student visa mainly process through the NSW student visa team, but I have had student visa issued from Adelaide before. So I guess if too many student visas they might “borrow” some of our COs from the Adelaide team to process the student visa applications, as there is a deadline for students to commence courses. Just my guess ...
